Your legal guarantees

Two separate statutory guarantees run alongside every sale. Neither is optional, neither can be signed away, and — this is the part that is often left unsaid — both apply to custom-printed pieces, even though those pieces are excluded from the 14-day right of withdrawal.

1. Guarantee of conformity — garantie légale de conformité

Articles L217-3 and following of the Code de la consommation. The goods must match their description, be fit for the purpose they are ordinarily used for, and have the qualities we announced.

  • Duration: two years from delivery.
  • Burden of proof: for the first 24 months any lack of conformity that appears is presumed to have existed at delivery. You do not have to prove it. We do.
  • Your remedies: repair or replacement, at your choice, free of charge and without significant inconvenience. If neither is possible, or we fail to do it within a month, you may reduce the price or cancel the sale and be reimbursed.
  • Repairs restart the clock: a repair made under this guarantee extends it by a further six months.
  • No cost to you: return carriage on a non-conforming item is ours.

On a printed piece this covers, among other things: a print that does not match the file you approved, dye that has not fixed properly and transfers onto other cloth, a seam that fails, a blank supplied in the wrong size or colour, and a print placed somewhere other than where you positioned it.

2. Guarantee against latent defects — garantie des vices cachés

Articles 1641 to 1649 of the Code civil. A separate guarantee covering hidden defects that make the goods unfit for their intended use, or so far reduce that use that you would not have bought them, or would have paid less, had you known.

  • Duration: two years from discovery of the defect.
  • Your remedies: return the goods for a full refund, or keep them and recover part of the price. Article 1644 leaves the choice to you.
  • If the defect caused you loss and we knew of it, you may also claim damages.

3. Both apply to personalised pieces

This bears repeating because the trade often muddles it. Being excluded from the 14-day right of withdrawal means only that you cannot change your mind about a piece we printed to your specification. It has no bearing at all on your guarantees. If a printed piece is defective, non-conforming or wrong, you are entitled to exactly the same remedies as a customer who bought a plain blank off the shelf.

4. What is a process characteristic rather than a defect

We publish, photograph and measure the limits of dye-sublimation before you order so that they are never a nasty surprise later. The following are inherent to the process and are not lacks of conformity:

  • Seam whitening. Pale speckling where fabric folds or doubles and the press cannot reach. Graded per blank, photographed in close-up, and marked on the preview before you buy.
  • Colour loss on blends. Non-polyester fibre takes no disperse dye. The percentage loss is stated on the blank, in the studio, and again in your cart.
  • Out-of-gamut colours. Areas the studio measured and flagged as unreachable before you paid, printing as the nearest achievable colour.
  • Gradual fading. Disperse dye is durable and does not crack or peel, but it is still a dye. Long exposure to strong light will soften it over time. We make no claim that it never fades.

If any of these appear beyond what we described — whitening far outside the marked zones, colour loss much greater than we quoted — that is a conformity problem and it is covered. Send us a photograph and we will tell you plainly which side of the line it falls on.

5. Making a claim

Write to support@trendsseason.site or call +33 7 63 04 90 75 with your order reference and, if you can, a photograph in daylight. You do not need to quote an article number or use any particular form of words. We answer within one working day and tell you the outcome, and the reason for it, in writing.

6. Commercial guarantee

We offer no additional paid commercial guarantee. The statutory guarantees above are what you have, and they are more than most commercial guarantees give.
